PLWHA and Travel to the USA
There have now been further developments in relation to the travel ban on PLWHA from entering, or migrating to, the US. While the US Senate had recently passed a bill (the PEPFAR reauthorisation bill) with an amendment repealing the HIV entry travel and immigration ban (since 1993), it has now been okayed by the House, signed and authorised by the US President George Bush bringing the HIV travel and immigration ban to closure: www.pinknews.co.uk ...What is currently unknown, however, is whether this repeal on the ban clears the way fully for PLWHA travelling to the US, since an additional – second - barring entry was previously added (in 1987) to the US Department of Health and Human Services (DHHS) disease regulation list which is yet to be rewritten.  That prohibition is separate from the travel/immigration entry restriction ban, but pressure is being brought to bear by US advocacy groups on US health officials to remove this regulation listing as the new statutory law no longer requires HIV to remain on that regulation list.  Until such times as the DHHS regulation is lifted (which is expected to take a further 12 months) PLWHA are advised to be customarily cautious when travelling to the US, as the current protracted HIV waiver (I-601) is still the only legal means of HIV entry (for business, conference, friends/family, medical grounds or leisure/tourism).  PLWHA are advised to contact the United States Embassy in Australia or the consulate-general in their home state, for further details.
